Tan is seeking a reduced sentence based on ineffective assistance of counsel at sentencing. Rochester criminal defense attorneys James Nobles and Brian DeCaroli represented Tan during sentencing for the gun charges and during the state murder trial.
Tan pleaded guilty to the three federal gun charges in a June hearing, two relating to the fact that he tricked his friend Whitney Knickerbocker ’18 into buying a gun for him, and one because he knew the gun would be used in a crime.
Tan was indicted on three federal gun charges in September 2017, and pleaded guilty in June to purchasing the gun used to kill his father in 2015.
In the new federal indictment, Charles Tan ’17 is accused of illegally receiving a firearm and ammunition with the intent of using them to commit a crime and convincing someone else to lie to buy them for him.
